DONALD LAUGHS OFF VODKA FOE

Page SixPhoto
April 20, 2009 --
IT'S the war of the vodka czars. Martin Silver, the owner of Georgi Vodka, says Donald Trump, who launched his own brand of Trump Vodka in 2006, is a hypocrite for firing Khloe Kardashian from "Celebrity Apprentice" because she was convicted of DUI. Silver raged to Page Six, "Everyone makes mistakes. If you sell spirits, why would you fire somebody who could have been a customer of Trump Vodka the night she was pulled over?" He even said he'll offer Kardashian a job with his company. But an unruffled Trump told us that Silver's slam "is a great compliment to me. It just shows how well Trump Vodka is doing. In fact, it is setting records. I'm very comfortable with my decision to fire Khloe and find it pathetic that a competitor has to stoop so low."

Ruth Madoff: What Did Bernie's Wife Know?

On Dec. 10, according to a court filing by the Madoffs’ lawyer, Mr. Madoff admitted to his wife and their two sons that his multibillion-dollar hedge fund was an elaborate Ponzi scheme. If that is true, Ruth Madoff learned of her husband’s crimes as suddenly as the rest of the world. One day, she was married to a stock-market genius, the next she was married to one of history’s great con men.

That, anyway, is the official Madoff version of events. At this point, as a mess that Mr. Madoff himself is said to have estimated at $50 billion lands in litigation, the main characters aren’t talking. In the absence of direct answers, all that’s left is the sort of psychological puzzle that belongs in Act II of a David Mamet drama, right before we find out who are the players and who are the played.

Was Mrs. Madoff really blindsided? In the social circles where the couple once traveled, both possibilities are unnerving — that Ruth Madoff was in on this, or that she wasn’t. If she isn’t a confederate, after all, then she arguably should be counted among Bernard Madoff’s victims. Either way, wittingly or not, she was an essential asset to her husband, humanizing him and drawing people into his orbit.

“All I will say on the subject is that it’s hard to imagine that she could live with the guy for 50 years and have no inkling,” says Donald Rosenzweig, a childhood friend of Ruth’s and an investor in Madoff Investment Securities. “Could she attract people to him? Yes. Was she out there shilling for him? I doubt it. But maybe.”

Federal prosecutors have not charged Mrs. Madoff with any crimes, and though she is currently living with her husband, who is under house arrest in their Upper East Side penthouse, she can come and go as she pleases. She has surrendered her passport and agreed to a deal with the United States attorney’s office that freezes her assets and grants her an undisclosed monthly allowance for living expenses, the cost of security for the couple and legal fees. The conditions of bail for Mr. Madoff include a $10 million bond secured by homes in Mrs. Madoff’s name. (huffingtonpost)

Sirius XM filing Chapter 11 Bankrupcty

Looks like Sirius XM Radio may be preparing to file for bankruptcy. Recent news reports that Sirius "thinks there's a 'high likelihood' that Sirius XM will fail to repay or refinance its debt in 2009" states the financial research firm Moody. Sirius XM contains $5 billion in assets but has over $3.25 billion in debt. Sirius XM would be the second largest Chapter 11 filing this year. Sirius XM seemed to be putting things back into perspective when XM Satellite and Sirius merged last year but with auto sales declining (vehicles sold with Sirius XM radio made a up a large portion of its customer base)the company needed to rethink its position. Although it doesn't look like Sirius XM customers will loose their service but it looks as if the company may have to terminate contracts with Shock Jock Howard Stern and Martha Stewart. Howard Stern signed a contract with Sirius that allows him to make $100 million a year.

Satellite company EchoStar may be looking to takeover Sirius XM by purchasing the companies debt. However, it is yet to be determined whether EchoStar is purchasing convertible or bank debt:

"—If Echostar is buying the convertible debt due in February, it could either be making a play for equity (it would have the option to convert the debt to equity), or planning to get in line behind the bank debt holders in bankruptcy proceedings.

—If Echostar is buying bank debt, it could be looking to take control of the company during bankruptcy proceedings as, again, bank debt holders are first in line for the assets." (forbes.com)

EchoStar also owns $400 million of Sirius XM’s debt. If Sirius XM files for bankruptcy, EchoStar could seek in court to take over the company. However, EchoStar may be able to negotiate to convert its shares before bankruptcy at an attractive rate and gain control of the company.

Tax Turkey Awards Given Out To Caroline Kennedy, Rep. Charles Rangel, Treasury Secretary Timothy Geithner, And Others

New York, NY: Brendan Pack, CEO of Tax Academy.com, a multimillion dollar company based in New York City and services over 100,000 companies, has announced today the annual Tax Turkey awards being given to government officials for their potential tax-related problems. The winner will receive a 14k gold "Tax Turkey" plaque. The top five are as follows:

Caroline Kennedy:
Quit her bid for Senate seat due to "personal" reasons, including "tax" problems. Sources cite that Kennedy ended her campaign for Hillary Clinton's vacant Senate seat due to "potentially embarrassing" situations with tax liabilities and employment with nanny. Ms. Kennedy's only tax issue on the public record appeared to be a $615 city tax lien that she settled in 1994, a minuscule amount for a multimillionaire.

Charles Rangel:
In 2008, the chairman of the tax-writing House Ways and Means Committee was accused of failing to report $75,000 in rental income for a villa he owned at the Punta Cana Yacht Club, in Punta Cana, Dominican Republic. Documents also released showed that Rep. Rangel paid no interest on a mortgage used to purchase the beach property. His attorney, Lanny Davis, claims these financial issues were unintentional, and Rep. Rangel wasn't previously aware of his failure to disclose the income because most of the mailings were sent to his wife. Republicans have called for the removal of the Congressman from the House Ways and Means Committee, which writes the nation's tax laws, and an investigation has been implemented.

Tom Daschle:
President Obama's pick to head the Health and Human Services Department, Tom Daschle, recently filed amended tax returns to report $128,203 in unpaid taxes and $11,964 in interest for 2005-2007. His amended taxes reflect additional income for consulting work, the use of a car service, and reductions in charitable contribution deductions. Daschle has paid the IRS taxes and interest for this error, which has delayed his confirmation as Obama's appointed advisor.

Timothy Geithner:
President Obama's pick for Treasury Secretary, Timothy Geithner, disclosed to Senators that he failed to report $34,000 in self-employment taxes from 2001-2004. Although his confirmation hearing was delayed, this tax mistake did not cost him his position as Treasury Secretary, which includes oversight of the IRS.

William Jefferson:
The Congressman was defeated in the 2008 election; however his controversy started a couple years prior to his loss. In 2006, the FBI raided Jefferson's home and claimed they found over $90,000 Jefferson took in bribes, some of the cash stashed away in the freezer. Rep. Jefferson was indicted on 16 charges of corruption by a federal grand jury and stripped of his membership on the House Ways and Mean's Committee, yet the controversy did not end. In June of 2008, his sister pleaded guilty to a Federal fraud scheme.
